Blue Earth County, MN Public Conduct: Public Marijuana Use (2026)

Blue Earth County adopted its cannabis article on November 19, 2024 under Minn. Stat. ch. 342 to regulate cannabis businesses and consumption after state legalization. Sec. 4-209 flatly bans consuming cannabis flower, cannabis products, lower-potency hemp edibles, or hemp-derived consumer products in a public place or place of public accommodation anywhere in unincorporated Blue Earth County. The only exception is an establishment or event that holds a license permitting on-site adult-use consumption, meaning ordinary sidewalks, parks, county roads, and businesses without that specific license remain off-limits for cannabis use even though possession and retail sale are otherwise regulated under the same article.

Sec. 4-206(d) makes any violation of Article IV a misdemeanor punishable by law, and specifies that a violation can occur whether or not a permit is required for the underlying activity, with each day a violation continues counted as a separate offense. The county administrator or a designee enforces the article, and the sheriff's office also runs at least one annual age-verification compliance check on licensed cannabis retailers under Sec. 4-203, though that check targets sales, not public consumption. Because cannabis retail itself is separately registered under Sec.

4-201 through 4-207, with the county capping registrations at one retail business per 12,500 residents, a person could lawfully buy adult-use cannabis at a registered county retailer and still be committing a misdemeanor by consuming it outside that retailer's licensed on-site consumption area, in a park, on a public road, or at another business open to the public.
