Rockdale County, GA Public Conduct: Public Marijuana Use (2026)

Rockdale County Code § 66-3 flatly prohibits possession of one ounce or less of marijuana within the unincorporated areas of the county, defining marijuana broadly to track the Georgia Controlled Substances Act definition (all parts of the cannabis plant, its resin, and derivative compounds, with the state's sample and sterilized-seed exceptions carried over). Because the ordinance bars possession anywhere in the unincorporated county rather than only on private property, it reaches marijuana carried, held or consumed in public places such as streets, parks and parking lots, and the Sheriff's Office cites it as a Code violation independent of any state marijuana charge.

Section 66-3 was adopted in 2001 and has not been repealed, so it still applies even though the county has since adopted a separate loitering-for-drug-activity ordinance (§ 66-6) aimed at open-air dealing rather than simple possession. A person found with marijuana in a public place in unincorporated Rockdale County can be cited under § 66-3 for possession itself, the same way a person found with it in a private residence would be.
