Albany, NY Public Conduct: Public Urination (2026)

Albany City Code § 255-41 makes it a violation to urinate or defecate in any public place other than a restroom: defined broadly to include streets, sidewalks, alleys, parking areas, municipal parking ramps, parks, playgrounds, and even the hallways and lobbies of apartment buildings and hotels outside individual units. First offenses draw a fine up to $250 and/or up to 15 days in jail; a second violation within three years raises the fine to $350, and a third or subsequent violation within three years raises it to $500, each still carrying up to 15 days in jail. The article was added in 1998 by Ord. No. 21.32.98.
