Section 232-1N is one subsection of Chapter 232's long list of acts 'deemed disorderly and against the public peace and order,' added October 27, 2009 by Ord. No. O-09-30. The rule has two branches: urinating or defecating in a place that is itself public (a street, park, parking lot, or municipal building), or doing so on private property while the act is 'in public view,' meaning visible to passersby even though the underlying land is not public. That second branch covers a backyard, driveway, or side lot that faces a street or neighboring property where the act can be seen.

The chapter groups this offense alongside disorderly conduct, fighting, unlawful dumping, and the fireworks and lighting-nuisance provisions, all enforced under the same penalty and violation framework in Section 232-2. Freehold Township's Police Department is the practical enforcer, since Chapter 232 offenses are typically charged by summons rather than through the Code Enforcement Officer's civil notice process used for property-maintenance chapters. There is no separate fine schedule specific to this subsection; it defers entirely to the Township's general penalty chapter, and a single incident is charged as one offense rather than a per-day violation, unlike continuing-condition offenses such as unmowed lots or improperly stored yard waste.
