Long Branch, NJ Public Conduct: Public Urination (2026)

Code § 253-1, adopted March 13, 1984 by Ordinance No. 1154 (originally Section 6-19 of the 1971 Code), forms Article I of Chapter 253, Peace and Good Order, and reaches farther than most public-nuisance rules: it bars urinating in public on any property, private or public, so a violation can happen on a business lot, a private yard or a beach in the City of Long Branch, Monmouth County, not just on a city street or in a park. The article carries no separate fine schedule of its own; § 253-2 instead ties enforcement to the citywide general penalty at Code § 1-16, which applies whenever the Code does not spell out a specific maximum for a violation.

That general schedule lets a Municipal Court judge impose a fine of up to $2,000, up to 90 days in jail, up to 90 days of community service, or any combination, though the same section also allows a lesser or even nominal penalty where appropriate. Because each day a violation exists is treated as a separate offense under § 1-16, a continuing situation, rather than a single incident, can expose a violator to repeated charges. Chapter 253 also houses unrelated Peace and Good Order rules, including a motor-vehicle nuisance article, but § 253-1 stands alone as the city's only public-urination prohibition.
