Summary

Bergen County treats a skateboard as a 'Motorized Vehicle or Device' under its park ordinance, and that classification bars skateboards from every path, multi-use path, shared-use path, cartway, sidewalk, and sidewalk area in the county park system, except a permanent or authorized driveway, alongside bicycles, mopeds, scooters, carts, and similar devices.

These county ordinances apply to unincorporated areas of Bergen County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

A. No person, unless authorized by the County of Bergen, shall use or operate any type of motor-driven vehicle or device, including but not limited to, cars, recreation vehicles, trucks, bicycles, mopeds, cars, motorcycles, unicycles, all-terrain vehicles, segways, scooters, carts, and skateboards upon any path, multi-use path, shared-use path, cartway or on any designated pedestrian path, sidewalk, or sidewalk area, except upon a permanent or duly authorized temporary driveway. As used herein "Motorized Vehicle or Device" shall mean an electric or gas-powered vehicle or device that is equipped with a helper motor but shall not include a mobility disability-related motorized personal mobility transportation devices. B. Motorized Vehicles or Devices shall be operated at a moderate speed, not to exceed 10 Miles Per Hour, within park premises and in no event at a speed exceeding the posted speed limit or a limit prescribed by the Department of Motor Vehicles of the State of New Jersey.

Full Breakdown

Article III(z)(1) of the Bergen County Parks System Rules and Regulations, 'Motorized Vehicles or Devices,' defines that term in Article I to include skateboards by name, listed alongside cars, trucks, bicycles, mopeds, motorcycles, unicycles, all-terrain vehicles, segways, scooters, and carts, even though a skateboard has no motor. Whatever the label, the operative bar in (z)(1)(A) is unambiguous: no one may use or operate a skateboard, or any of the other listed devices, upon any path, multi-use path, shared-use path, cartway, or designated pedestrian path, sidewalk, or sidewalk area anywhere in the Bergen County Park System.

The single carve-out is a permanent or duly authorized temporary driveway, which in practice gives a skateboarder nowhere lawful to ride within a county park, since driveways are built for vehicle access, not recreation. Subsection (z)(1)(B) caps the speed of any covered device at 10 miles per hour where it is otherwise permitted, and never faster than a posted limit or a limit set by the state Motor Vehicle Commission. Subsection (z)(1)(C) separately bars using park premises to teach or learn to operate any of the listed devices, so a parent cannot use an empty parking lot to teach a child to skateboard either.

The county's separate Article II list of 'Regulated Uses' includes roller skating as an activity permitted only in County-designated times and areas, underscoring that wheeled recreation generally is confined by the Department rather than left open to any park path. Because a skateboard cannot be authorized under (z), a rider who wants a legal place to skate in Bergen County needs to look to a municipal skate park rather than county park pathways.

Violations & Fines

Riding a skateboard on a county park path, cartway, or sidewalk is a prohibited act under Article III, enforced by Bergen County Parks Department staff and the Bergen County Sheriff's Office. A violator faces the ordinance's general penalty: a fine of $100 to $2,000, up to 90 days in county jail or 90 days of community service, or both, and can be ejected from the park, with a seasonal or lifetime ban possible for repeat conduct.

Frequently Asked Questions

Can I skateboard on the paths in a Bergen County park?
No. Article III(z)(1)(A) of the park ordinance defines a skateboard as a 'Motorized Vehicle or Device' and bars it from every path, multi-use path, shared-use path, cartway, and sidewalk in the county park system, with the only exception being an authorized driveway.
Why does Bergen County call a skateboard a motorized device if it has no motor?
The county's own definition in Article I lists skateboards by name inside the 'Motorized Vehicle or Device' definition alongside bicycles, scooters, and carts, regardless of whether the device actually has a motor, so the path and cartway ban in Article III(z) applies to skateboards the same as it does to mopeds.
Is there anywhere in a Bergen County park I can legally skateboard?
The ordinance leaves only permanent or duly authorized temporary driveways open to a skateboard, and it separately bars using park premises to teach or learn to ride one. Riders looking for a legal place to skate should look to a municipal skate park rather than county park property.
