Full Breakdown

15 makes it unlawful to ride a skateboard, roller skates, roller blades or a similar device on public property the county has posted against that activity, and names seven properties as posted no-skate zones: the Elkhart County Courthouse and Jail in Goshen, the County Administration Building in Goshen, the County Courts Building in Elkhart, Lincoln Center and Hudson Clinic in Elkhart, and Rush Memorial Center in Bristol. The ban extends to every parking area and sidewalk the county owns that services those properties. 16 separately bans using any of the covered devices in a way that threatens injury or property damage, obstructs or endangers pedestrians or motorists, or creates loud or unreasonable noise, wherever that happens on public property.

17 defines PUBLIC PROPERTY broadly to include any county- or Park and Recreation Board-owned property, expressly naming county sidewalks and parking areas. 18 requires posting with a specific sign text warning that the activities 'are prohibited by Elkhart County Ordinance' and that 'each violation is punishable by a fine of up to $50,' placed at every vehicular and primary pedestrian entrance; the prohibition only takes effect once a site is actually posted this way. 19 carves out devices built to move infants or handicapped and incapacitated persons and carts used to move purchased merchandise, and lets the Commissioners suspend the ban by resolution for special events.

Violations & Fines

Under § 130.99(B), a first violation of the skateboarding, roller skating and roller blading subchapter costs $25; any second or later violation, whether of the same or a different section within that subchapter, costs $50. Cases proceed as state-law infractions under I.C. 34-28-5 with a complaint and summons issued by the Sheriff's Department or another police agency, and fine revenue goes to the county General Fund.

Frequently Asked Questions

Where exactly is skateboarding banned in Elkhart County?
Section 130.15(B) names seven posted properties: the County Courthouse and Jail in Goshen, the County Administration Building in Goshen, the Courts Building in Elkhart, Lincoln Center and Hudson Clinic in Elkhart, and Rush Memorial Center in Bristol, plus their parking areas and sidewalks.
How much is the fine for skateboarding in a posted area?
A first violation of § 130.15 costs $25 under § 130.99(B)(1). A second or later violation of any provision in the skateboarding subchapter, even a different section, raises the fine to $50, and court costs are added on top in either case.
Are wheelchairs or delivery carts covered by the skateboarding ban?
No. Section 130.19 exempts devices built for transporting infants, handicapped or incapacitated persons, and wheeled devices used to carry merchandise from place of purchase, along with any other wheeled device the Commissioners choose to exempt for special events.
Can skateboarding be banned somewhere the county hasn't posted signs?
No. Section 130.15(A) only makes riding unlawful 'where the property has been posted as prohibiting' the activity, and § 130.18(B) says the ban applies to a property 'once the property or area has been posted with signs.' An unposted county property isn't covered.
