Summary
After a hearing finds repeated critical food-safety violations or unsafe staff practices, County Environmental Health can order a food facility to send all food-prep staff to an approved handler class under Ordinance Code § 4.56.080.
When the County Health Officer, or his/her designee, during an administrative hearing, determines either of the following:
a.Repeated violation of critical factors affecting food safety, as defined in CURFFL Section 113946; orb.The owner or employee with the Food Safety Certification has failed to ensure that all employees who handle unpackaged food have sufficient knowledge and understanding of how to safely prepare and serve food. The County Health Officer, or his/her designee, may require the owner to send all staff who engage in food preparation to an approved food handler program as defined in CURFFL. The food safety education class shall include, but not be limited to, the following:
a.Causes and contributing factors of food-borne illness, the relationship between time and temperature with respect to food-borne illness, and the relationship between personal hygiene and food safety;b.Methods of preventing food contamination in all stages of food handling; andc.Procedures for cleaning and sanitizing food handling equipment and utensils. Full Breakdown
§ 4.56.080 lets the County Health Officer order mandatory food-safety training only after an administrative hearing determines either repeated violations of critical food-safety factors under CURFFL § 113946, or that an owner or Food Safety Certification holder failed to ensure staff who handle unpackaged food understand safe practices. The ordered class must cover causes of food-borne illness, time-and-temperature control, personal hygiene, contamination prevention, and cleaning and sanitizing procedures. This is a corrective remedy triggered by violations, not a baseline handler-card mandate for every worker.
Violations & Fines
The section is itself a remedy, not a standalone penalty: it authorizes ordering staff into an approved food handler program once a hearing finds repeated critical violations or inadequate staff food-safety knowledge.
