Full Breakdown

Kane County Code Sec. 15-2(D)(5) makes it unlawful to allow an infestation of insects, vermin, rodents or other pests on any property outside the corporate limits of a city or village. The duty to fix it falls on the owner: every owner of a property, building or structure must exterminate any infestation caused by a failure to keep the building in a rodentproof or reasonably insectproof condition, and that owner responsibility extends to shared or public areas of a multi-unit building. An occupant of an individual unit only picks up the extermination duty when the occupant, not the owner, actually caused the infestation.

The nuisance declaration sits inside the same Sec. 15-2 list that separately bans accessible household garbage, overflowing junk and trash storage, and unfly-tight or non-rodentproof garbage cans and privies, all Exterior Property Areas and Animals and Infestations provisions the county enforces together. Enforcement starts with a written notice under Sec. 15-5 describing the violation, its location, and what has to be done to correct it by a stated date; if the owner or occupant does not abate the infestation in time, the county's authorized representative can file a complaint under the chapter 2 administrative adjudication process, seeking abatement, fines or injunctive relief.

If the owner or occupant still does not exterminate after due notice, Sec. 15-7 lets the county's authorized representative arrange the extermination itself and bill the owner, agent or occupant for the cost, and any unpaid cleanup bill becomes a special lien against the property at the next tax roll, carrying interest at the legal rate until paid.

Violations & Fines

A rodent or pest infestation left unaddressed is a Sec. 15-2 nuisance violation fined up to $500.00 per day under Sec. 15-6, with every day the infestation continues counting as a separate offense. If the owner or occupant does not exterminate after notice, the county can do it and bill the cost, which becomes a lien on the property if unpaid.

Frequently Asked Questions

Who is responsible for exterminating rodents at a rental property in Kane County?
The property owner is, under Sec. 15-2(D)(5), when the infestation was caused by a failure to keep the building rodentproof, including infestations in shared or common areas. An individual occupant only takes on the extermination duty for their own unit if that occupant is the one who caused the infestation there.
What can Kane County do if I don't get rid of a rodent infestation?
After written notice under Sec. 15-5 giving you a deadline to fix it, the county can arrange extermination itself and bill you for the cost under Sec. 15-7. An unpaid bill becomes a special lien against the property at the next tax roll, and the county can still pursue a Sec. 15-6 fine of up to $500.00 per day on top of that.
Does the rodent nuisance rule apply inside cities like Aurora or Geneva?
No. Kane County Code Sec. 15-2 applies only to property located within the county but outside the corporate limits of any city or village, so unincorporated areas are covered while Aurora, Geneva, Batavia and the county's other cities enforce their own property maintenance codes for rodent and pest control.
