Full Breakdown
080 creates the Rental Housing Safety Program (RHSP) under Section 802 to raise the share of rental units meeting the city's housing safety standards. Section 803 requires every owner of residential rental property, unless exempt, to annually complete the Rental Housing Safety Program Certification Checklist, give a copy to each tenant whose unit was inspected, and, if the owner cannot certify full compliance including because a tenant refused entry, submit the checklist to the City by July 1 of each year. Newly built rental units get a five-year exemption from certification starting at the certificate of occupancy.
Owners or tenants can request a City inspection in place of self-certification, and any tenant can ask the City to verify the accuracy of an owner's checklist; submitted checklists are public records. Section 805 lets the City Manager or a designee proactively inspect any residential rental unit, but caps proactive inspections at once every three years for units that keep current on the annual self-certification, unless the City responds to a service request or reasonably believes a unit violates the law. 48 that this section does not limit.
Section 806 adds reactive inspections triggered by tenant complaints, referrals from other officials, or visibly deteriorated exteriors. A clean inspection produces a Certificate of Compliance under Section 807, reviewable within ten days by the Building Official.
Violations & Fines
Failing to certify, submit a checklist, or fix a cited violation after written notice is an infraction under BMC Chapter 1.20. The City Attorney can also sue civilly for up to $500 per violation, plus attorneys' fees if the violation is declared a public nuisance. A tenant who never received the required checklist copy can sue directly for up to $500 per violation and recover attorneys' fees if they prevail.
