Owners shall allow the city to conduct an inspection of their residential rental properties for compliance with all applicable codes and the city's housing and property maintenance standards. The director, in his or her discretion, may include inspections by other city departments including, but not limited to, fire, building and safety, code enforcement or public health.B.Upon completion of the inspection, if no violations are identified, the director shall proceed with the issuance of a rental housing business license. If one or more violations are identified, then the director shall issue a notice of correction to the owner describing the violation and setting forth a time within which such violations shall be corrected. The owner shall pay a re-inspection fee in an amount established by resolution of the city council for each re-inspection following the issuance of notice of correction. (Ord. No. 2020-14, § 2(Exh. A), 1-19-21; Ord. No. 2022-15, § 2(Exh. A), 11-15-22)

Full Breakdown

Owners must allow the city to inspect residential rental properties for compliance with applicable codes and housing/property maintenance standards; inspections may include fire, building and safety, code enforcement, or public health staff. If violations are found, the director issues a notice of correction and owners pay re-inspection fees until compliance is confirmed. Properties with no code violations in the prior year may instead complete an annual self-certification with dated photos in lieu of a full inspection. The city may still inspect a unit's interior if the property presents a public health risk or significant safety issue.

Violations & Fines

Re-inspection fees for each follow-up visit; a notice of correction with a compliance deadline; uncorrected violations are declared a public nuisance and pursued through code enforcement.

Frequently Asked Questions

Can Hesperia inspect the inside of my rental unit?
Yes: if the city determines the property poses a public health risk or has significant safety issues, it may inspect interior units and common areas under HMC § 5.72.130.
Can I avoid a full inspection?
Yes: if your property had no code violations in the prior year, you may apply for annual self-certification with photos instead of a city inspection.
