Sec. 42.6. - RELOCATION ASSISTANCE REQUIREMENTS: A.Requirement for Relocation Assistance.1.If a landlord issues a termination notice based on a no-fault just cause described in Section 42.5(B)(2) to a tenant of a rental unit covered by this Chapter, the landlord shall, regardless of the tenant's income, at the landlord's option, do one (1) of the following:a.Assist the tenant to relocate by providing a direct payment to the tenant...b.Waive in writing the payment of rent for the final month of the tenancy... 3.The amount of relocation assistance or rent waiver shall be equal to one (1) month of the tenant's rent that was in effect when the landlord issued the notice to terminate the tenancy. B.Relocation Assistance for Eligible Residential Households...3.The cash equivalent of three (3) months of Fair Market Rent shall be paid to the eligible residential household minus the amount paid pursuant to Subsection (A) above.4.Special-circumstances households...will be paid one (1) additional month of Fair Market Rent for a maximum of four (4) months' Fair Market Rent...

5(B)(2), such as owner move-in, withdrawal from the rental market, a government habitability order, substantial remodel, or demolition. Regardless of the tenant's income, the landlord must, at its option, either pay a direct relocation payment or waive in writing the rent for the final month of tenancy; either form of assistance equals one month of the rent in effect when the termination notice issued, and must be provided within 15 calendar days of service of the notice. If the tenant fails to vacate after the notice period expires, the City lets the landlord recover that assistance as damages in an unlawful detainer action.
6(B): a full refund of their security deposit (less damage repair costs), a 60-day subscription to a rental agency service at fair market pricing, and a cash payment equal to three months of HUD Fair Market Rent for a comparable unit, minus the base one-month payment already made. 3(J) as including seniors 62 or older, disabled members, households with minor dependents, or five-plus-year tenants, receive one additional month of Fair Market Rent, for a maximum of four months total. The City Manager's Office determines eligibility, and landlords pay an administrative processing fee set by City Council resolution.
Tenants must file a complete relocation application within 15 calendar days of the termination notice, and the City must approve or deny within 10 business days; a denial may be appealed in writing to the City Clerk within 10 calendar days, with a decision from the City Manager's designee within 10 business days.
Violations & Fines
A landlord's failure to strictly comply with Section 42.6, including missing the 15-day payment deadline or the notice-of-termination content requirements in Section 42.6(D), renders the notice of termination void under Section 42.6(A)(6). Under Section 42.8, that noncompliance also gives the tenant a complete affirmative defense to any eviction or rent-collection action, plus the right to sue for actual damages, treble damages for willful, oppressive, fraudulent or malicious conduct, punitive damages, injunctive relief, and attorneys' fees and costs.
