Summary
Eugene landlords who raise rent by the state's maximum annual percentage under ORS 90.324 must deliver a written 90-day notice under EC 8.425(17)(c) stating the new rent, the dollar and percentage increase, and the tenant's right to request two months' relocation assistance. Eugene Code is current through Ordinance 20739, passed June 8, 2026.
(c) Rent Increases. 1. Except for those landlords and tenancies exempt from payment of relocation assistance as provided in subparagraphs (f) and (g) of this subsection (17), a landlord that intends to increase a tenant’s rent by the maximum annual rent increase percentage as set by the State of Oregon pursuant to ORS 90.324 must deliver a written notice of rent increase to each affected tenant at least 90 days before the date of the rent increase designated in the notice. The notice of rent increase must specify the amount of the new rent, the dollar amount by which the rent will increase, the percentage of the increase, and the date the increase will become effective. ... 2. A tenant who receives the notice of rent increase required by subparagraph (c)1. of this subsection (17), may, within 30 days of the date of the notice, request in writing relocation assistance from the landlord. 3. If a tenant requests relocation assistance pursuant to subparagraph (c)2. of this subsection (17), the landlord must pay the tenant relocation assistance in an amount equal to two months’ rent for the dwelling unit.
Full Breakdown
324. The landlord has to deliver a written notice at least 90 days before the increase takes effect, stating the new rent amount, the dollar amount of the increase, the percentage of the increase, the effective date, and a description of the tenant's rights and obligations regarding relocation assistance; letting a rent concession simply expire is not treated as an increase for this purpose. 425(17)(c)2 gives the tenant 30 days to request relocation assistance in writing. If the tenant asks, the landlord must pay relocation assistance equal to two months' rent for the dwelling unit, due at least 45 days before the increase's effective date, calculated per unit rather than per tenant.
After receiving the payment, the tenant has 45 days to either give written notice of termination and move out, or repay the relocation assistance and stay at the new rent. 425(17)(d) limits a tenant to one relocation assistance payment per tenancy, and repaying money to stay under this subsection does not use up that one-time allowance. 425(17)(f)-(g) apply the same way as for no-cause terminations.
Violations & Fines
The city manager investigates rent-increase complaints under EC 8.430(2), which requires the landlord be given 48 hours to respond to a tenant's written notice before a case opens for EC 8.425(14)-(16) issues, or ten days for other subsections. A confirmed violation triggers a notice and order under EC 8.430(5); ignoring it exposes the landlord to a fine of up to $250 per violation under EC 8.995, with each day counted separately.
