Summary

Every short-term rental in unincorporated Kane County must be registered annually with the Development and Community Services Department on a form naming the owner, a 24-hour local contact, the property address and the advertised listing details, filed anew each year before the license can be renewed.

City-specific rules exist: Aurora, and Elgin have their own rental registration rules that differ from Kane County's county-level regulations. If you live in one of those cities, check the city-specific page instead.

All short-term rentals shall be registered annually with the Kane County Development and Community Services Department. Applications for new short-term rental licenses and renewals of short-term rental licenses shall be on a form created by the Kane County Development and Community Services Department, which shall include, but is not limited to, the following information: A. Short-term rental owner name and contact information. B. Full name and valid contact information for person or company who will serve as a local agent on behalf of the short-term rental owner and will be available as a twenty-four (24) hour contact. C. Short-term rental property site address. D. A copy of the proposed short-term rental listing, which includes the total number of bedrooms, bathrooms/toilets, parking spaces, and maximum number of guests allowed in the short-term rental.

Full Breakdown

Section 7-62 of the Kane County Code requires every short-term rental to be registered annually with the Development and Community Services Department, on an application form the Department creates rather than a generic county template. The registration must include the short-term rental owner's name and contact information, plus the full name and valid contact information for a local agent who will serve as a 24-hour point of contact on the owner's behalf. Owners must also list the property's site address and provide a copy of the proposed listing itself, spelling out the total number of bedrooms, bathrooms and toilets, parking spaces, and the maximum number of guests the listing advertises.

Section 7-62 gives the Director authority to demand any other information reasonably necessary to complete the application, and every application must include a signed affidavit in which the owner affirms compliance with the short-term rental article, all federal, state and local laws, and any applicable neighborhood covenants or restrictions. Because the license itself lapses if not renewed by January 31 under Section 7-61, the annual registration filing effectively doubles as the renewal filing: an owner who skips a year's registration loses the license and must start the whole process over with a brand-new application rather than a simple renewal.

Registration materials submitted under Section 7-62 also feed the county's enforcement file, since the 24-hour local contact and listing details support the separate neighbor-notice requirement in Section 7-65.

Violations & Fines

A short-term rental operating without a current, complete Section 7-62 registration is treated as unlicensed under Section 7-68, exposing the owner to a fine of up to $1,000 per day and possible suspension or revocation of any license already issued. The State's Attorney's Office can also seek an injunction to stop the rental.

Frequently Asked Questions

What information does Kane County require on a short-term rental registration?
Section 7-62 requires the owner's name and contact information, a 24-hour local agent's name and contact details, the property's site address, and a copy of the listing showing bedroom, bathroom, parking and maximum guest counts. The Director can also ask for any other information reasonably needed to complete the application.
Does Kane County require a local contact for short-term rentals?
Yes. Section 7-62 requires the full name and valid contact information for a person or company who serves as a 24-hour local agent on the owner's behalf, so the county and neighbors have someone reachable at any hour if a problem arises at the rental.
How often must I re-register my Kane County short-term rental?
Every year. Registration under Section 7-62 is filed annually alongside the license renewal, and because the license itself is forfeited if not renewed by January 31 under Section 7-61, missing a year's registration means starting the whole application over from scratch.
