Subsection B lists what it must contain: the name and address of the record owner or owners, with physical addresses because post office boxes alone are insufficient; an in-state person authorized to accept notices and service of process if the owner lives outside New Jersey; the name of the superintendent or maintenance person; an emergency representative with authority to make repair and expenditure decisions; every holder of a recorded mortgage; the fuel oil dealer and grade if the landlord furnishes oil heat; and the exact number of sleeping rooms in each unit, backed by a floor plan attached to the form.
The Clerk indexes the forms and makes them reasonably available for public inspection, and the filing is designed to satisfy N.J.S.A. 46:8-28 at the same time. An amended form is due within 20 days after any change in the information, with no fee unless ownership of the premises changes. Under § 162-15, no rental unit can be registered unless all municipal taxes and other municipal assessments are paid at the time of filing.
Money attaches in two places. Section 74-19(B) of the fee chapter lists a rental certificate of occupancy for yearly inspection at a $100 nonrefundable fee per unit registered by April 1 of each calendar year, and a $150 penalty fee for failure to register by April 1 or for occupying without a certificate of occupancy. Section 162-31 requires rental unit owners to carry liability insurance of no less than $500,000, or $300,000 for a multifamily home of four or fewer units with one owner-occupied, and to register the certificate of insurance annually.
Violations & Fines
Occupying, or permitting occupancy of, an unregistered rental unit is unlawful under § 162-9(F). Chapter 162 violations carry a fine of not to exceed $1,000, up to 90 days in the county jail, or both under § 162-30, with each day a separate offense. Missing the insurance registration in § 162-31 carries a fine of not less than $500 but no more than $5,000.
