Overland Park runs a rental licensing and inspection program under OPMC Chapter 5.75. Every rental dwelling needs a license, renewed every two years, and the city inspects the exterior of the property before issuing or renewing it.
OPMC 5.75.040 makes it unlawful to rent or allow occupancy of a rental dwelling without a license. One license covers each building under common ownership; separately owned units in the same building each need their own. Hotels, motels, hospitals, nursing homes, assisted living, jails, and religious residences are exempt under 5.75.030(B). Licenses renew biennially under 5.75.070(B). The inspection under 5.75.110 is exterior only — buildings and common areas — and may occur without notice; the city has no routine interior inspection right and states in 5.75.010(B) that it will not arbitrate landlord-tenant disputes. Interior habitability problems run through the Property Maintenance Code (OPMC 7.25) and the Nuisance and Unsafe Structures Enforcement Act (OPMC 7.04.150 et seq.).
Renting without a license is a misdemeanor punishable under OPMC 1.12.010 by up to $500 and six months, each day a separate offense.
