Newton, MA Right to Farm: Agricultural Zoning Protection (2026)

Sec. 1 of Chapter 30's Open Space Uses article defines agriculture to include horticulture, silviculture, floriculture, and viticulture, without further limiting what farming activity qualifies. The allowed-use tables that run through Articles 2, 3, and 4 apply that definition district by district, and each one draws the same line: 'Agriculture, on a parcel of 5 or more acres' is marked 'P,' meaning it is allowed by right, while 'Agriculture, on a parcel under 5 acres' is marked 'SP,' meaning it needs a special permit from the City Council, across the residential, Business, Mixed Use, and Manufacturing districts as well as the Public Use/Open Space districts.

Sec. ' Because the ordinance does not set a separate dimensional or setback standard for agricultural use beyond the 5-acre threshold, an agricultural operation on a large enough parcel otherwise follows the general dimensional rules of whatever district it sits in, and the acreage cutoff functions as Newton's only agriculture-specific zoning control, distinguishing hobby-scale farming on a small residential lot from a larger, unsupervised farming operation.
