Apex, NC Right to Farm: Farm Nuisance Protection (2026)

Apex carves bona fide farms out of its own zoning rulebook. UDO Sec. 1.4.4 says farms meeting the North Carolina General Statutes' bona fide-farm definition are exempt from the Ordinance entirely: no zoning permit, use approval, or dimensional standard under the UDO applies to that operation. The exemption reaches across both the Apex corporate limits and the mapped extraterritorial jurisdiction, since UDO Sec. 1.5.1 applies the Official Zoning District Map to 'the Town and its ETJ.' This is a zoning-code carve-out, not the separate North Carolina Right to Farm Act nuisance statute. The UDO was codified July 27, 2021, and this export carries no ordinance-history note dating the provision further.
