Summary

Farm houses, barns, and other agricultural buildings in unincorporated Linn County are exempt from the entire zoning chapter as long as they're actually used for farming: floodplain rules are the one carve-out.

These county ordinances apply to unincorporated areas of Linn County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

No regulation or requirement contained in this chapter, other than regulations related to land division, shall be construed to apply to land, farm houses, farm barns, farm outbuildings, or other buildings, structures, or erections which are primarily adapted, by reason of nature and area, for use for agricultural purposes, but only while so used. However, regulation or requirements that relate to any structure, building, dam, obstruction, deposit or excavation in or on the floodplains of any river or stream shall apply. (b)Agricultural areas. All agricultural areas created pursuant to I.C.A. § 352.6 and the activities conducted thereon, are and shall remain exempt from county zoning and building regulations. However, regulation or requirements that relate to any structure, building, dam, obstruction, deposit or excavation in or on the floodplains of any river or stream shall apply. (Code 2006, ch. 41, art. 5, § 2)

Full Breakdown

Linn County Code § 107-92(a) pulls farm buildings out of the zoning chapter entirely: no zoning regulation applies to land, farmhouses, barns, or other structures "primarily adapted...for use for agricultural purposes, but only while so used." The exemption tracks actual use, not a permit or designation, so it disappears the moment a building stops being farmed and reapplies if farming resumes. Floodplain, dam, and excavation rules still apply regardless. This only covers unincorporated county land. Cedar Rapids, Marion, and the county's other incorporated cities enforce their own zoning codes and don't recognize this exemption.

Violations & Fines

There's no permit to violate: losing agricultural use simply pulls the property back under the standard zoning chapter, requiring compliance like any other structure.

Frequently Asked Questions

Does this exemption apply inside Cedar Rapids?
No. Cedar Rapids and Linn County's other incorporated cities have their own zoning codes; this county exemption covers only unincorporated Linn County land.
Do I need to file anything to claim the exemption?
No permit or designation is required: it applies automatically to farm buildings and land actually used for agriculture under § 107-92(a).
