Cupertino allows both hosted and unhosted short-term rental stays, but unhosted stays (no host or operator on site) are capped at 60 nights per year. The operator must always provide a local contact who can respond to complaints within 60 minutes.
Under Cupertino Municipal Code Section 5.08.030, a short-term rental may be either hosted (the operator present on site) or unhosted, but unhosted stays are limited to 60 nights per year. Hosted stays, where the operator remains on the premises during the rental, are not subject to that 60-night annual cap. Because the unit must be the operator's primary residence, the ordinance treats the short-term rental as incidental to the operator's own occupancy. Whether hosted or unhosted, the operator must designate a local contact who can respond to any complaint within 60 minutes, maintain the guest manual and vehicle registry, and comply with occupancy, parking, and noise limits. Only one rental agreement is permitted per night.
Exceeding 60 unhosted nights per year, or failing to maintain a responsive local contact, violates CMC Section 5.08.030 and is enforced under Chapter 1.12, up to revocation of the registration.
