Because the CUP is discretionary, the Planning Commission can consider whether a rental is hosted or non-hosted when evaluating neighborhood compatibility and when setting conditions of approval; a non-hosted (whole-home) rental may draw more scrutiny over noise, parking, and management than an owner-occupied hosted room. There is no codified host-presence mandate, no required on-call response time, and no local-contact requirement spelled out in the municipal code; any such operational condition would arise only as a condition of an individual CUP.
Because Dublin does not impose a host-presence mandate, there is no standalone violation for operating a non-hosted rental. However, operating either a hosted or non-hosted short-term rental without the required Bed and Breakfast Inn Conditional Use Permit, business license, and TOT registration is enforceable by Code Enforcement as an unpermitted use and tax violation. If the Planning Commission attaches a management or local-contact condition to a specific CUP, failing to honor it is a permit violation that can support modification or revocation of the CUP.
