DMC Chapter 5.70 (Weeds and Refuse) lets the City Council declare overgrown weeds and accumulated refuse a public nuisance and order abatement after notice and a hearing. "Weeds" follows California Government Code Section 39561.5. Owners must clear their lot plus the abutting half of adjacent streets/alleys.
Dublin's weed-control authority is in Municipal Code Chapter 5.70. DMC 5.70.020 bars owners from permitting weeds and/or refuse to remain or accumulate on their property or on public sidewalks and streets between the property and the street centerline, and requires owners to destroy or remove weeds from their lot and from the abutting half of any adjacent street or alley. "Refuse" includes dry grass, leaves, yard clippings, wood, and similar nonputrescible solid wastes (DMC 5.70.010). The City Council may pass a resolution declaring weeds a public nuisance (DMC 5.70.030). The owner then receives notice and a hearing; DMC 5.70.070 requires the City to give notice specifying a scheduled abatement date at least ten (10) calendar days out (with five extra days if mailed). If the owner does not abate, the City may remove the weeds by cutting, discing, chemical spraying, or other methods (DMC 5.70.060), keep an account of costs (DMC 5.70.080), and, after a confirmation hearing, recover those costs as a special assessment collected on the next property tax roll (DMC 5.70.110). Owners may always abate themselves before the City does, at their own expense. This framework is especially relevant for fire-fuel weed clearance in Dublin's dry season.
If the owner fails to abate, the City performs the work and recovers the cost as a special assessment on the lots and lands, collected on the next tax roll until paid (DMC 5.70.080-5.70.110).
