South Fulton does not require the host to be on site, but Sec. 12-3006 requires every STR to designate a short-term rental agent (the owner or a natural person over 18) reachable 24 hours and able to appear at the property within 45 minutes of a city notification about noise, disturbances, or code violations.
Rather than mandating on-site host presence, South Fulton uses a 'responsible-agent' model. Section 12-3006 requires the owner to designate a short-term rental agent on the permit application; the owner may serve as the agent or designate another natural person over age 18, and only one agent may be in place at a time. Section 12-3005(a)(3) requires the agent's 24-hour contact information on the application, and the application form labels it the '24-hour contact phone.' The agent's duties in Sec. 12-3006(b) are to: (1) be reasonably available to handle any problems arising from use of the unit; (2) appear on the premises within 45 minutes following notification from the city about issues including unreasonable noise, disturbances, disorderly conduct, overcrowding, or alcohol/drug violations; (3) receive and accept service of any notice of violation; and (4) monitor the unit for compliance. Failure of the agent to timely appear in response to two or more complaints may be grounds for penalties. The posted permit inside the unit (Sec. 12-3008) must display the agent's name, address, telephone number, and email so guests and neighbors can reach a responsible party at all times.
Failing to designate a qualified STR agent, or the agent's failure to appear within 45 minutes for two or more complaints, is grounds for penalties under Chapter 3, including the Sec. 12-3009 fines ($500/$750/$1,000) and potential permit revocation.
