Boise does not cap the number of nights a short-term rental can operate per year because Idaho Code Β§67-6539B forbids cities from prohibiting STRs or restricting their duration as residential use.
Many cities limit unhosted stays to 90 or 180 nights per year, but Boise cannot do this under Idaho's 2017 preemption framework. Section 67-6539B requires municipalities to allow STRs as residential use, which Idaho courts and the Attorney General have interpreted to bar night caps and similar duration limits. Boise Title 11 Chapter 11-04 therefore tracks registration, taxes, and complaints without imposing nightly ceilings. Operators may run year-round listings as long as they stay current on registration, transient occupancy taxes, and the neutral noise and parking rules that apply.
No fines exist for exceeding a night threshold because no threshold exists; complaints instead go through nuisance, noise, or registration enforcement.
