East Orange Chapter 228 (adopted 6-10-2024 by Ordinance 14-2024) requires every short-term rental transient occupant to comply with Chapter 184 Noise Pollution. Music played in residential areas between 10:00 p.m. and the following morning may not exceed 65 dBA measured at 25 feet or the next adjoining property line. Applicants with any Noise Pollution Ordinance violation in the prior two years are barred from receiving an STR permit.
On June 10, 2024 the East Orange City Council adopted Chapter 228, Short-Term Rentals, by Ordinance 14-2024, layering a registration regime on top of the existing Chapter 184 Noise Pollution code (originally adopted February 22, 1982). Chapter 228 makes transient occupants directly responsible for complying with all city noise and nuisance ordinances and authorizes Department of Property Maintenance and East Orange Police Department response to STR-related disturbances. Chapter 184 sets a 65 dBA limit (A-weighted scale) for amplified music in residential areas between 10:00 p.m. and the following morning, measured at 25 feet from the source or at the next adjoining full property line. The chapter also prohibits unmuffled internal-combustion engines and unpermitted horn or siren use. As an additional STR-specific deterrent, Chapter 228 requires that an applicant for a short-term rental permit have no Noise Pollution Ordinance violations within the two years preceding the application; a single sustained noise complaint can therefore disqualify the property from STR licensing. Operating an STR that produces noise in excess of Chapter 184 limits exposes both the transient occupant and the permit-holder to summonses from the East Orange Police Department, and counts as a disqualifying violation under Chapter 228 for two years.
