Honolulu ordinance limits a bed and breakfast home to two guest rooms and four guests at one time, and caps overnight transient occupants at two adults per allowable sleeping room city-wide.
ROH Sec. 21-5.730(b)(3), enacted by Ordinance 22-7, sets occupancy and sleeping-arrangement standards for B&Bs and TVUs. No more than two guest rooms in a bed and breakfast home may be rented, and a maximum of four guests are permitted within the B&B at any one time. For all registered STRs, no more than two adults may sleep in each allowable room used for sleeping accommodations, and the total number of adult overnight transient occupants may not exceed two times the number of rooms provided for sleeping. All overnight transient occupants must be registered with the owner or operator, who must keep a current two-year registry of occupant names, phone numbers, and stay dates. The property may not be used for gatherings of ten or more individuals who are not registered overnight occupants. Functioning smoke and carbon monoxide detectors must be installed in each transient-occupant bedroom and connected hallway. Nonconforming B&Bs in residential districts are likewise limited to two rooms and four adult transient occupants (Sec. 21-4.110-2).
Exceeding occupancy limits is grounds for administrative fines, nonrenewal, and registration revocation.
