Hampton's short-term rental rules adopted in 2024 cap a standard Zoning Administrator permit at five bedrooms and ten overnight guests. Properties exceeding either threshold require a discretionary Use Permit reviewed by the Planning Commission and City Council.
Under Hampton's STR framework (effective September 1, 2024), an administrative Zoning Administrator Permit is the standard pathway for rentals with up to five bedrooms and a maximum of ten overnight guests. Larger properties or those proposing higher occupancy must apply for a Use Permit, which goes through public hearings before the Planning Commission and City Council. As part of either application, operators submit a floor plan that identifies each bedroom, room dimensions, and the location of safety equipment so staff can verify the proposed sleeping capacity. The required local responsible party must be reachable in case occupancy or noise issues arise during a stay.
Exceeding the permitted occupancy or operating without the correct permit type can result in fines of up to $1,000 issued every ten days of continued non-compliance, along with permit revocation.
