Chapter 350 of the Jackson Township Code, adopted by Ordinance No. 12-20 on August 11, 2020, governs short-term rentals. The chapter's stated purpose is to curtail and in certain cases prohibit the renting of dwellings on a short-term basis to transient guests in residential neighborhoods. Whole-dwelling short-term stays are not authorized; only single-room rentals are permitted, and even those must satisfy strict conditions. The Code requires a minimum tenancy of one month and a maximum of one tenant per registration, the dwelling must be owner-occupied year-round, the dwelling must contain at least two bedrooms, and it must hold a Rental Certificate of Occupancy. The dwelling must comply with all applicable health, safety, construction, zoning, and fire codes, and the landlord must file a registration with the Township under Chapter 245 (Landlord Registration). The State Housing Code (N.J.A.C. 5:28) sets a minimum 70-square-foot floor area for any sleeping room.
Operating a sub-30-day rental, exceeding one tenant, or renting from a non-owner-occupied home violates Chapter 350 and is enforced by the Code Enforcement Officer and Police Department. Each day of non-compliance is a separate offense and the Rental Certificate of Occupancy may be suspended or revoked.
