Under Jackson Township Code § 162-4A(5), the Construction Official's Division of Inspections charges a construction permit fee for new fencing of $0.33 per linear foot for a residential property and $0.38 per linear foot for a commercial property, subject to a minimum fee of $100 for a residential permit and $140 for a commercial permit; updating an existing residential permit costs $50 and a commercial update costs $70. The code carves out a specific exemption: no permit is required for a fence under six feet in height, but that exemption disappears the moment the fence serves as a barrier around a swimming pool, because § 244-216B(8) separately requires pool enclosures to meet strength, height and gate-latch standards regardless of the general fence height cutoff.

Enforcement of the Uniform Construction Code, including fence permits, runs through the Division of Construction: under § 3-74G, when the Construction Official or a subcode official issues a notice of violation, the property owner generally gets 30 days to bring the fence into compliance before a fine is assessed under the state UCC fine schedule, unless public health or safety requires faster action.
