Chapter 350 of the Jackson Township Code (Ord. 12-20) conditions room rentals on the owner maintaining all required insurances in sufficient coverage amounts and furnishing proof to the Township as part of the rental certification process. Unlike some New Jersey municipalities, Jackson Township does not specify a fixed liability dollar minimum in Chapter 350. The applicable statewide floor is set by N.J.S.A. 46:8-39 (enacted by P.L. 2022 c.92 / S1368): owners of residential rental units must maintain liability insurance of at least $500,000 per occurrence, except that owners of owner-occupied two-, three-, or four-unit dwellings may carry a minimum of $300,000. Standard New Jersey homeowner policies typically exclude transient or business use, so most insurers require a short-term-rental endorsement or separate landlord policy. Jackson Township short-term-rental owners are also subject to the State Occupancy Fee and Sales Tax framework in N.J.S.A. 54:32D for any taxable transient stay.
Failure to maintain required insurance or provide proof violates Chapter 350 and is enforced by the Code Enforcement Officer and Police Department. Each day of non-compliance is a separate offense and the Rental Certificate of Occupancy may be revoked.
