Summary

Pottstown requires an annual inspection and license for short-term rentals, which the Property Maintenance Code defines as rooming houses, hotels, motels, bed-and-breakfasts or similar facilities where different occupants stay a month or less at a time. Section 113.10 puts the inspection and licensing fee on the owner or the owner's agent, and ties the license to a 75% compliance threshold across all units in the facility.

Section 113.10. Short-Term Rental Units. All rooming houses, hotels, motels, bed-and-breakfasts or similar facilities that house people, property or business on a short-term basis where different people occupy a unit for a period of time of one month or less shall be inspected for code compliance once a year, unless such unit is exempt pursuant to § 204 of Chapter 11. It is the responsibility of the owner or the owner's agent to arrange for such inspection and to pay the fee therefor, which fee shall be established from time to time by resolution of the Borough Council. An annual license shall be issued for the short-term rental facility, provided that a minimum of 75% of the individual units comply with all Borough codes. Certificates of occupancy will be issued for individual units, and any individual unit that does not comply with all Borough codes will not receive a certificate of occupancy and shall not be occupied until all code violations have been corrected and a certificate of occupancy has been issued.

Full Breakdown

10 was added to Part 3 of Chapter 5, Code Enforcement, through the same 2022 "Additions to Code" amendment, Section 303, that created the property-transfer inspection scheme in this Part. It defines a short-term rental as any rooming house, hotel, motel, bed-and-breakfast or similar facility that houses people, property or business for a period of one month or less where different people occupy the unit, and it requires that use to be inspected for code compliance once a year unless the specific unit is exempt under Section 204 of Chapter 11, Housing.

The owner or the owner's agent has to arrange the inspection and pay the inspection fee, which Borough Council sets by resolution rather than in the code itself. An annual license issues for the facility as a whole only if at least 75% of its individual units comply with all Borough codes at inspection. Compliance is also tracked unit by unit: the Borough issues a certificate of occupancy per unit, and any unit that fails inspection does not get a certificate and cannot be occupied until its violations are corrected and the certificate is issued.

That two-tier structure lets a facility keep its overall annual license while individual noncompliant rooms stay offline until they pass. 11 layers on a related duty for any owner who lives outside Montgomery, Chester or Berks County: that owner must designate, in writing, an in-county agent authorized to receive the Borough's notices.

Violations & Fines

Operating a short-term rental facility without the required annual license, or without the unit-level inspection, exposes the operator to the same Property Maintenance Code enforcement track as any Chapter 5 violation, including a notice of violation from the Code Enforcement Officer and referral for summary prosecution if it is not corrected. A noncompliant unit simply cannot be occupied: it is barred from receiving a certificate of occupancy until the cited violations are fixed and reinspected.

Frequently Asked Questions

Do short-term rentals need a license in Pottstown?
Yes. Section 113.10 requires an annual license for any rooming house, hotel, motel, bed-and-breakfast or similar facility renting to different occupants for a month or less at a time, and the license only issues facility-wide if at least 75% of its individual units pass a code-compliance inspection.
Who has to arrange the short-term rental inspection?
The owner or the owner's agent. Section 113.10 puts the duty to schedule the annual inspection, and to pay the inspection fee Borough Council sets by resolution, on the owner or their designated agent, not on the Borough or on individual guests staying at the property.
What happens if one unit in a short-term rental fails inspection?
That specific unit loses its certificate of occupancy and cannot be rented until its violations are corrected and reinspected, even if the facility as a whole keeps its annual license because at least 75% of its other units remain in compliance with Borough codes.
Do out-of-area owners have extra duties for short-term rentals?
Yes. Section 113.11 requires any rental owner who does not live in Montgomery, Chester or Berks County to designate, in writing, an authorized agent who does live in one of those three counties to receive the Borough's notices on the owner's behalf.
