Summary

Anyone renting out lodging accommodations, including a private residence, in unincorporated Spalding County must register the business with the Department of Community Development under Code § 6-1180 within 30 days of the requirement taking effect, and pay a $25 annual administrative fee, rising to $75 after January 1, under § 6-1190 to receive a lodging certificate.

These county ordinances apply to unincorporated areas of Spalding County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

Every person engaging in or about to engage in the business of providing lodging accommodations, as above defined, in the special district shall immediately register said business with the Spalding County Department of Community Development, as the duly authorized representative of Spalding County, a political subdivision of the State of Georgia, on a form provided by the Spalding County Department of Community Development for such purpose. Persons engaged in such business must so register no later than thirty (30) days after the date this section becomes effective ... In order to comply with the mandates of the applicable laws of the State of Georgia, an administrative fee is hereby implemented on any business or person under the purview of the within article. Said administrative fee shall be in the amount of twenty-five dollars ($25.00) payable annually. Said administrative fee shall be remitted to the Spalding County Department of Community Development, before January 1 of each year that this article is in effect. The administrative fee after January 1 will be seventy-five dollars ($75.00). Spalding County shall issue a lodging certificate to said enterprise paying said administrative fee.

Full Breakdown

Registration under § 6-1180 requires the operator's business name, the address of each rental location, a mailing address, a principal contact person, and any other information the county needs to collect the tax; the form must be signed by the owner, a corporate officer, or a partner depending on entity type. A realtor offering multiple cabins for rent is treated as a single place of business and files one registration rather than one per cabin (§ 6-1180(3)), but an operator running units under separate names or locations must register each one, and file the same number of tax returns Georgia requires for state sales tax purposes when several units share one tax ID (§ 6-1180(4)).

Once registered, the tax commissioner or the Department of Community Development issues a certificate of authority naming the business and its location (§ 6-1181). Section 6-1190 layers on a separate $25 annual administrative fee, due before January 1 each year the article is in effect, rising to $75 if paid after January 1; paying it is what earns the operator a lodging certificate. This registration is required in addition to, not instead of, the county's standard business occupation tax registration under § 6-1084.

Violations & Fines

Operating lodging accommodations without registering is a violation of the article, punishable on conviction by fine or imprisonment under § 6-1187(4) and Code § 1-1007. An operator who fails to file the required monthly or quarterly return can be assessed the tax by county estimate plus penalties under § 6-1185, and closing the business without notifying the Department of Community Development in writing within 30 days, as § 6-1188(b) requires, leaves both seller and buyer exposed for the unpaid tax.

Frequently Asked Questions

Do I need to register a short-term rental in Spalding County?
Yes. Code § 6-1180 requires every operator of lodging accommodations, including a private residence rented more than two days a year, to register the business with the Department of Community Development on the county's form before beginning to rent.
Is there a fee to register a short-term rental?
Yes. Section 6-1190 sets a $25 annual administrative fee, due before January 1 each year, rising to $75 if paid after that date; paying it is what gets the operator a lodging certificate.
What happens if I rent out several cabins under one business?
Section 6-1180(3) treats a realtor offering multiple cabins for rent as a single place of business needing only one registration, rather than a separate filing for every cabin.
