Summary

Any short-term rental in unincorporated Yakima County needs a conditional use permit before it can host paying overnight guests. Yakima County Code § 19.18.420 defines a short-term rental as a dwelling rented to guests for fewer than 30 consecutive days, limits a single parcel to five rental units, and requires Planning Division review before an owner can legally start booking.

City-specific rules exist: Yakima has its own short-term rental permits rules that differ from Yakima County's county-level regulations. If you live in Yakima, check the city-specific page instead.

(2) Permitted zones. Short-term rental use is a permitted use in all zoning districts that allow residential dwellings as a permitted use. (3) Eligible dwellings and limitations. The residential unit must be a legally established residence as defined by the building and planning departments. No more than five short-term rental units shall be allowed on a single parcel. Where a single parcel of property contains a combination of any of the following: residential unit, private room, or ADU; no more than five units shall be eligible to function as a short-term rental. (4) A conditional use permit for short-term rental approval. A conditional use permit for the short-term rental use of an eligible dwelling unit must be completed and submitted to the County for review. If compliance with the provisions of this chapter is demonstrated, approval for a short-term rental use will be issued.

Full Breakdown

420 of the Yakima County Code governs every short-term rental in the unincorporated county, defined in subsection (1)(a) as a residential dwelling unit, or portion of one, rented to overnight guests for fewer than 30 consecutive days. Subsection (2) makes the use permitted in any zoning district that already allows residential dwellings as a permitted use, so the underlying zone controls whether an STR is possible at all. Subsection (3) sets the eligibility floor: the unit must be a legally established residence as defined by the building and planning departments, and no more than five short-term rental units are allowed on a single parcel, whether the units are a residential unit, a private room, or an accessory dwelling unit.

Subsection (4) is the operative permit rule: an owner must complete and submit a conditional use permit application to the County, and the County issues approval only after the owner demonstrates compliance with the rest of the chapter, including the occupancy, parking, and signage criteria in subsection (5) and the business license and tax requirements in subsection (6). The chapter was adopted by Ordinance 4-2022 and amended by Ordinance 5-2023, and it carries its own severability clause in subsection (7) so that if one part is struck down the rest of the permit scheme stays in force.

Because the CUP is a discretionary land-use approval rather than a ministerial registration, the Yakima County Planning Division can attach site-specific conditions, and the permit runs with the specific dwelling unit reviewed, not with the owner generally.

Violations & Fines

Operating a short-term rental without an approved conditional use permit is a zoning violation the Yakima County Code Enforcement Official can pursue as a Class I Civil Infraction under YCC § 21.04.030, carrying a default penalty of up to $250 per violation, with each day of unpermitted operation treated as a separate offense under § 21.04.020. The County can also deny future development or business permits on the parcel until the violation is corrected.

Frequently Asked Questions

Do I need a permit to operate an Airbnb in unincorporated Yakima County?
Yes. YCC § 19.18.420(4) requires a conditional use permit before any dwelling can operate as a short-term rental. The application goes to the Yakima County Planning Division, which will not approve it until the owner shows the property meets the eligibility, occupancy, parking, signage, and licensing standards in the rest of the chapter.
How many short-term rentals can I run on one property?
No more than five. Subsection (3) caps a single parcel at five short-term rental units total, counting any combination of a residential unit, a private room, or an accessory dwelling unit toward that limit.
Which properties qualify for a short-term rental permit?
Only a legally established residence in a zoning district that already permits residential dwellings qualifies. YCC § 19.18.420(2) and (3) tie eligibility to the underlying zoning and to building and planning department recognition of the unit as a lawful residence.
What happens if I rent short-term without the county permit?
Yakima County Code Enforcement can issue a Class I Civil Infraction under § 21.04.030, with a default penalty up to $250, and each day of continued unpermitted operation counts as a separate violation under § 21.04.020.
