Indiana's STR chapter does not let a city confine short-term rentals to a host's primary residence. IC 36-1-24-8 makes owner-occupied STRs a permitted residential use, and IC 36-1-24-9 says that for a non-owner-occupied STR a city may require a special exception, special use, or zoning variance, but may not interpret and enforce its zoning to prohibit or unreasonably restrict such rentals. Anderson has no primary-residence-only ordinance, so investment and second-home STRs are allowed, subject to any applicable variance process and generally applicable safety and tax rules. 2026's HEA 1210 further bars local caps on rental properties.
