Summary

Before excavating, building a driveway, installing sidewalks or curbs, planting or removing street trees, or placing signs in a County road right-of-way in unincorporated Yuba County, you need an encroachment permit from the Public Works Department under Yuba County Code § 9.50.020. An unpermitted advertising sign in the right-of-way is a public nuisance the Road Commissioner may remove immediately.

These county ordinances apply to unincorporated areas of Yuba County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

Frequently Asked Questions

Do I need a permit to put in my own driveway?
Yes. Section 9.50.020 requires a permit before installing, constructing, cutting into or repairing a driveway, sidewalk, curb, gutter, road approach or road surfacing in a County road right-of-way. Apply through the Public Works Department on the Commissioner's approved form and pay the processing fee set in § 13.20.600 before starting work.
Can the County make me remove an illegal sign from the right-of-way?
Yes. Any advertising sign or device placed or displayed in a County highway without a permit is declared a public nuisance under § 9.50.020(4), and the Road Commissioner may remove it immediately, unless it is a notice posted as required by law or by court order.
How long do I have to start work once I get a permit?
You must commence work within 30 days of the permit being granted, or within whatever longer period up to 60 days the Commissioner sets (§ 9.50.190). Special single permits under § 9.50.040 run on the same 30-day clock from their effective date; unexcused delay lets the Commissioner terminate or suspend the permit.
What happens if the Commissioner denies my permit?
You can apply to the Board of Supervisors for review under § 9.50.280. If the Board finds you were not actually in default on a prior permit, it can order the Commissioner to issue the permit you were denied.
