New Orleans, LA Sidewalk & Pedestrian Rules: Encroachment Permits (2026)

Division 4 of Chapter 146 governs private encroachment onto public sidewalks. Section 146-532 flatly states that use of any sidewalk or other public space for the extension of a licensed business is unlawful without a sidewalk use permit, the umbrella authorization covering sidewalk cafés, A-frame signs, and merchandise displays. Section 146-542, "Conditions and restrictions," then defines how thin that permit right actually is: it is subject to modification, suspension, or revocation at any time the city needs the area cleared for street, sidewalk, or utility repair or other public purposes; it is non-transferrable and cannot be assigned to a new occupant of the location; it is automatically suspended for two hours before, during, and two hours after any carnival parade on a parade route; and the director of safety and permits may suspend it without notice ahead of any permitted special event requiring crowd control.

Police, fire, and other emergency agencies may order immediate removal or relocation of encroaching items in an emergency, and the city bears no liability for components relocated during such an emergency. Critically, § 146-542(h) states that issuance of a permit does not grant, convey, or infer any vested right to use of the sidewalk, nor does it constitute a deed, easement, or servitude, the city can revoke or deny renewal for noncompliance with the division, the Code, or the Comprehensive Zoning Ordinance at any time.
