Full Breakdown

City Code § 38-40 requires a permit before anyone installs curb and gutter, lowers a curb, or creates, repairs, or modifies a driveway or ramp within the city's right-of-way lines. The director of public works approves the plans, materials, and construction method, and vehicle access from a public street to private property is allowed only over an approved driveway or ramp built under those conditions. A separate permit is required to remove a discontinued driveway and restore the area to the standard street and sidewalk pattern.

Violations & Fines

Installing or altering a driveway, curb, or gutter in the right-of-way without a permit violates § 38-40; absent a more specific penalty elsewhere in the chapter, it is a Class 4 misdemeanor under § 38-2.
