Summary

Placing a driveway, pipeline, sign, billboard, or other structure inside a county road right-of-way in unincorporated Utah County requires prior permission from the County Commission, or the County can remove it, bill the owner, and add ten dollars per day it stayed.

City-specific rules exist: Orem, Provo, and Eagle Mountain have their own encroachment permits rules that differ from Utah County's county-level regulations. If you live in one of those cities, check the city-specific page instead.

Enforcement: If any person places, constructs, or maintains any approach road, driveway, pole, pipeline, conduit, sewer, ditch, culvert, billboard, advertising sign, or any other structure or object of any kind or character within the right-of-way of any county road, without first obtaining permission from the County Commission, the Commissioners may: remove such installation from the right-of-way or require such person to remove the same...

Full Breakdown

010(A) bars anyone from placing, constructing, or maintaining an approach road, driveway, pole, pipeline, conduit, sewer, ditch, culvert, billboard, advertising sign, or any other structure or object within a county road right-of-way without first obtaining permission from the County Commission. If an unpermitted encroachment goes in anyway, the Commissioners can remove it directly or serve written notice, by personal service or registered mail plus a posted copy on the installation for ten days, giving the responsible person ten days to remove it. If it is not removed in time, the County may remove it at that person's expense and recover both the removal cost and ten dollars for every day the installation remained in the right-of-way after notice was complete.

If the person disputes the installation or refuses removal, the Commission can sue to abate it as a nuisance and recover the same daily ten-dollar charge plus court costs. 030 requires permission for bridges, ditches, waterways, headgates, and water mains crossing a right-of-way. 06 (Road Access Permits), issued by the County Engineer rather than the Commission, with its own fee, application, and design standards including driveway width and spacing limits.

Violations & Fines

An unpermitted structure or object left in the right-of-way after a ten-day removal notice exposes the responsible party to the County's removal costs plus ten dollars for each day the installation remained after notice, and if the County has to sue to abate it as a nuisance, the responsible party also owes the County's court costs.

Frequently Asked Questions

Do I need a permit to put a sign or pipe in the county road right-of-way?
Yes. Utah County Code § 8.03.010 requires permission from the County Commission before placing an approach road, driveway, pole, pipeline, conduit, sewer, culvert, billboard, sign, or similar structure or object within any county road right-of-way.
What happens if I install something without a permit?
The County can remove it directly or serve a ten-day written removal notice; if you miss the deadline, the County may remove it at your expense and add ten dollars for every day the installation stayed in the right-of-way after the notice was complete.
Is a driveway access permit the same as an encroachment permit?
No. General encroachments like signs, poles, and pipelines need County Commission permission under § 8.03.010, while driveway access onto a county road is a separate permit issued by the County Engineer under Chapter 8.06, with its own application, fee, and design standards.
