Full Breakdown

Yuba County Code § 8.40.020 makes it unlawful to loiter, stand, or sit in or upon any public highway, alley, sidewalk or crosswalk in unincorporated Yuba County so as to hinder or obstruct the free passage of persons or vehicles, or to annoy or molest people passing along it. Chapter 8.40, adopted by Ordinance No. 230 and titled 'Seditious or Obscene Language, Obstruction of Public Way, Picketing, Etc.,' also reaches the approach to a public building: § 8.40.030 separately bars loitering, standing or sitting at the entrance of, or approach to, any church, hall, theatre, park or place of public assemblage so as to obstruct that entrance or approach.

The Chapter cross-references Penal Code § 647, the state disorderly-conduct statute, as its underlying state-law analogue. The same Chapter also regulates related public-way conduct: § 8.40.010 makes it unlawful to utter seditious language reasonably foreseeable to provoke a breach of the peace, and §§ 8.40.040 through 8.40.080 restrict beset-and-picket conduct tied to compulsion, coercion, intimidation, threats, or violence against employees, employers, or patrons. None of that displaces the sidewalk-blocking rule in § 8.40.020, which applies regardless of the reason for the obstruction. Section 8.40.100 carves out an express exception: nothing in the Chapter prohibits peaceable picketing or lawful attempts by labor to achieve its aims through peaceable means, including collective bargaining, so a peaceful, non-obstructive picket line does not itself violate § 8.40.020.

Violations & Fines

Any violation of Chapter 8.40, including blocking a sidewalk or public way under § 8.40.020, is a misdemeanor under § 8.40.090, punishable by imprisonment in the County Jail not exceeding six months, a fine not exceeding $1,000.00, or both. The Yuba County Sheriff enforces the Chapter alongside other Title VIII public-peace-and-safety provisions. Each instance of obstruction can be charged separately, and the Chapter's severability clause (§ 8.40.110) keeps any one invalidated provision from voiding the rest.

Frequently Asked Questions

Is it illegal to stand around on a sidewalk in Yuba County?
Only if it hinders or obstructs someone else's passage, or annoys or molests passersby. Section 8.40.020 targets loitering, standing or sitting that blocks free passage on a highway, alley, sidewalk or crosswalk; simply standing on a sidewalk without impeding anyone does not violate the section.
Does this rule apply to protests or picket lines?
Peaceable picketing is expressly protected. Section 8.40.100 states nothing in Chapter 8.40 prohibits peaceable picketing or labor's peaceable attempts to achieve its aims, including collective bargaining, so a non-obstructive picket line does not violate § 8.40.020, though blocking passage while picketing can still be charged.
What's the penalty for blocking a sidewalk?
It's a misdemeanor under § 8.40.090, punishable by imprisonment in the County Jail not exceeding six months, a fine not exceeding $1,000.00, or both. The Yuba County Sheriff can issue a citation or make an arrest for a violation observed on unincorporated county roads and sidewalks.
Does the rule cover blocking a building entrance too?
Yes. Section 8.40.030 separately makes it unlawful to loiter, stand or sit at the entrance of, or approach to, a church, hall, theatre, park or other place of public assemblage in a way that obstructs that entrance or approach, alongside the general sidewalk-blocking rule in § 8.40.020.
