Cherokee County, GA Sidewalk & Pedestrian Rules: Obstruction Rules (2026)

Sec. 38-81(a)(1) bans obstructing any public street, public highway, public sidewalk, or other public place or building by hindering, impeding, or tending to hinder or impede the free and uninterrupted passage of vehicles, traffic, or pedestrians. Subsection (a)(2) reaches further, barring any act or thing on a public street, sidewalk, or place that obstructs or interferes with the free use of property or with a business lawfully conducted there, which covers physical encroachments such as merchandise, signage, or equipment left blocking a storefront's sidewalk frontage.

This obstruction rule is distinct from the county's separate motorized-cart sidewalk ban in Sec. 50-1, which only bars gas-powered vehicles, carts, and scooters on sidewalks, and from the sit-lie prohibition in Sec. 38-85, which targets camping and sleeping rather than physical blocking of the right-of-way. The obstruction rule was adopted as part of Article IV, Loitering, Soliciting, Panhandling, by Ord. No. 2008-O-001, and applies countywide in the unincorporated area; the Cherokee County Sheriff's Office and County Marshal's Office issue citations under the shared Article IV enforcement scheme in Sec. 38-86.
