Summary
Polk County's parking ordinance bars stopping, standing or parking any vehicle on a sidewalk anywhere in the unincorporated county. The rule sits inside the broader stopping-and-standing article that also blocks vehicles from intersections, crosswalks and bicycle paths, and the Sheriff's Office and code enforcement officers issue escalating fines for repeat violators under the Polk County Parking Ordinance.
Except when necessary to avoid conflict with other traffic, or in compliance with law or the directions of a police officer or official traffic-control device, no person shall:(a)Stop, stand, or park a vehicle:1.On the roadway side of any vehicle stopped or parked at the edge or curb of a street.2.On a sidewalk.3.Within an intersection.4.On a crosswalk.
Official source re-checked September 7, 2026: no newer edition of the code had been published (publisher’s edition: Code of Ordinances: Supplement 109 | Land Development Code: Supplement 12).
Full Breakdown
3-17 of the Polk County Parking Ordinance makes it unlawful to stop, stand or park a vehicle on a sidewalk, within an intersection, on a crosswalk, on a bicycle path, or within thirty feet of a safety zone, except when avoiding a traffic conflict or complying with a police officer's directions or a traffic-control device. 3-18, unless it is loading, unloading, or engaged in agricultural harvest. "Right-of-way" is defined broadly to include sidewalks, shoulders, medians, ditches, curbs and gutters. The Polk County Sheriff's Office, code enforcement officers, and any other authorized county official may enforce the parking ordinance.
1945(3), Florida Statutes; when a code enforcement officer handles it, the case follows the Polk County Code Enforcement Special Magistrate Ordinance procedures. Beyond citations, the county may pursue injunctive or declaratory relief in circuit court against a chronic offender. The ordinance was adopted by Ordinance No. 86-35 in 1986 and amended by Ordinance Nos. 14-020 and 2022-027.
Violations & Fines
Section 10.3-21 sets a graduated fine schedule for parking violations, including sidewalk obstruction: a first violation draws only a warning, a second violation costs $100, a third costs $250, and a fourth or subsequent violation costs $500. Handicapped-space violations under section 10.3-19 carry a flat $100 fine regardless of prior offenses. Fines are set per person, not per vehicle, so repeat offenders accumulate escalating penalties over time.
