(a)Except as provided herein, or as otherwise permitted by law, it is unlawful to make any use of the rights-of-way in a manner that interferes with the safe and efficient movement of people and vehicles from place to place on a road or right-of-way. Such prohibited activity includes by way of example and not limitation:(1)Stopping, standing or otherwise occupying a median that is not a sufficient pedestrian refuge on an arterial or collector road within Polk County, Florida by a pedestrian when that pedestrian is not in the process of lawfully crossing the road in accordance with applicable traffic and safety laws. ... First offense: A civil fine of up to a maximum of twenty-five dollars ($25.00). Second offense: A civil fine of up to a maximum of fifty dollars ($50.00). Third or subsequent offense: A maximum penalty of up to sixty (60) days [in] jail and up to a five hundred dollar ($500.00) fine.

Section 15-387 gives two concrete examples: a pedestrian stopping, standing or otherwise occupying a median on an arterial or collector road that is not a "sufficient pedestrian refuge," when not actively crossing, and any physical exchange, such as handing over money or merchandise, between a pedestrian and a vehicle occupant while that vehicle sits in the travel lane and is not legally parked (a vehicle stopped at a red light does not count as legally parked).
A median counts as a "sufficient pedestrian refuge" under § 15-386 only if it is a continuous raised-concrete median at least 15 feet wide, or any other median at least 40 feet wide, measured roadway-edge to roadway-edge. Standing on an insufficient median through two consecutive chances to cross safely is "prima facie evidence" of a violation. The division exempts law enforcement, utility and survey crews working lawfully in the right-of-way, people rendering emergency aid, transit riders boarding or leaving a bus, and permitted street closures for special events, and § 15-388 makes clear nothing in the division authorizes conduct Florida Statutes otherwise forbid.
