LDC Sec. 216 bans commercial vehicles, defined to include heavy machinery, dump trucks, tractor-trailer rigs, and vehicles with more than two axles, from residential lots. Exemptions include trucks under two tons capacity, under 9 feet high and under 26 feet long; one commercial vehicle on a 5-acre-plus A/RR parcel kept 20+ feet from boundaries; permitted construction and utility vehicles; agricultural equipment; and anything stored fully enclosed. Otherwise, a Land Use Hearing Officer may grant a special exception for one registered vehicle, kept out of the front yard, 20+ feet from boundaries, buffered where within 200 feet of residential property, valid one year.
Enforced by Polk County Code Enforcement via the Special Magistrate Ordinance; violations can bring daily fines until the vehicle is removed or exempted.
