Hamilton, NJ Sidewalk & Pedestrian Rules: Obstruction Rules (2026)

Chapter 306 of the Hamilton Code sets the Township's operative sidewalk-obstruction standard, written around newspaper vending machines but stating the general right-of-way principles applied whenever a fixture rests on, projects into, or over a public sidewalk. Section 306-2B bars any placement that endangers the safety of persons or property, unreasonably interferes with or impedes the flow of pedestrians or vehicular traffic including legally parked cars, unreasonably interferes with ingress or egress from adjoining property, or interferes with traffic signs, signals, hydrants, call boxes, utility poles or mailboxes.

Fixtures must be weighted against unauthorized movement and grouped no more than four feet along a curb, with groups separated by at least 20 feet, under Section 306-2D. Section 306-2F sets specific setbacks: fixtures cannot be placed within 12 feet of a marked or unmarked crosswalk, five feet of a fire hydrant or driveway, three feet of landscaping between curb and sidewalk, five feet of a no-stopping zone, or three feet of a bus shelter entrance. Section 306-3A caps dimensions at 48 inches in height, 24 inches in width and 20 inches in depth, and Section 306-3E requires the fixture be kept free of loose paint, rust, cracked viewing panels and torn inserts.
