Iowa City, IA Sidewalk & Pedestrian Rules: Obstruction Rules (2026)

City Code section 6-1-2M lists "Obstructing Public Ways And Property" among the enumerated public nuisances. The first branch covers physical encroachments: obstructing or encumbering public streets, alleys, sidewalks, and commons with fences, buildings, structures, or signs, unless the obstruction is permitted by agreement, easement, permit, or ordinance. The second branch covers activity-based blocking: any gathering of persons or vehicles on a public street or sidewalk, or any use of property abutting a street or sidewalk, that obstructs pedestrian or vehicular traffic or other lawful use of the street or sidewalk, again unless permitted.

Because this falls under the public nuisance chapter, section 6-1-3 makes creating or maintaining any enumerated nuisance unlawful, subject to the civil penalty schedule in section 1-4-2, and authorizes the city manager or a designee to abate the nuisance either through the municipal infraction process or administratively. Abatement remedies under section 6-1-4 can include removal, barricading, fencing, or other physical correction of the obstruction, with the cost of abatement assessed against the property like a property tax if the responsible party does not act. Separately, section 8-5-11 makes it a standing offense to congregate, stand, loaf, or loiter on a street, sidewalk, bridge, trail, or crossing so as to obstruct it or hinder passage, provable regardless of whether anyone was actually stopped from passing, punishable as a simple misdemeanor with a $50 fine.
