Summary

It's a misdemeanor in Killeen to block a sidewalk with merchandise, a vehicle, a chicken coop, or nearly anything else, or to hawk goods for sale on one, unless the city council issues a written permit for a citywide sidewalk sale. Each day the obstruction sits there is a separate offense, though the fine itself is a nominal one to ten dollars.

It shall be unlawful for any person in this city to place, keep or suspend any merchandise on or over the sidewalks, in front of any house or tenement or upon the sidewalk, to expose or offer any merchandise or other property for sale at auction or otherwise, or to obstruct any sidewalk by placing or leaving or causing to be placed or left thereon any vehicle, chicken coop, coal box, barrel, table, box or other articles or things whatever. Any person violating any of the provisions of this section shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined in a sum not less than one (1) nor more than ten dollars ($10.00). Each act as well as each day's violation of this section thereof shall be deemed a separate and distinct offense. Each member of a firm, partnership or corporation shall be deemed guilty and prosecuted as other individual persons. Notwithstanding the provisions contained in this section, a citywide sales promotional sidewalk sale may be held after a written permit has been obtained from the city council; such permit shall specify the days and hours such sidewalk sales are to be held.

Full Breakdown

Sec. 25-2, which dates to a 1967 ordinance, makes it unlawful to place, keep, or suspend merchandise on or over a sidewalk, to sell or auction goods there, or to obstruct a sidewalk with a vehicle, chicken coop, coal box, barrel, table, box, or virtually any other object left in the way. A conviction is a misdemeanor punishable by a fine of not less than one dollar and not more than ten dollars, and the code treats every act, and every day an obstruction continues, as a separate offense, so a display left out for a week can rack up multiple counts.

If the violator is a firm, partnership, or corporation, each member is prosecuted individually rather than the business as a whole. The one built-in exception is a citywide sales promotional sidewalk sale: a merchant can apply in writing to the city council for a permit that names the specific days and hours the sale may run, and once granted, that written permit lifts the obstruction ban for its duration. Sec. 25-3 carves out a narrower, ordinary-course exception too: a merchant receiving or shipping packages can stage them on the sidewalk without a permit as long as the stack doesn't cover more than half the sidewalk's width and doesn't sit there more than three hours, and a shopkeeper can display samples in a space no larger than two feet from the building line. Sec. 25-1 applies the code's general penalty, Sec. 1-8, to any Chapter 25 violation not otherwise addressed.

Violations & Fines

A first sidewalk obstruction conviction under Sec. 25-2 draws a fine between one and ten dollars, but because each day the merchandise or obstacle remains counts as its own offense, an item left in place for an extended period can generate a new charge daily. Businesses face the same fine per responsible individual, since each partner, member, or officer of a firm is prosecuted separately under the section.

Frequently Asked Questions

Can a Killeen store display merchandise on the sidewalk?
Not without a written council permit for a citywide sidewalk sale under Sec. 25-2; ordinary display of goods for sale on a public sidewalk is a misdemeanor, fined one to ten dollars for each day it continues.
Is there any exception to Killeen's sidewalk obstruction ban?
Yes. Sec. 25-3 lets a merchant stage packages being received or shipped on the sidewalk without a permit, as long as they cover no more than half its width and stay no longer than three hours.
How much is the fine for blocking a sidewalk in Killeen?
Between one and ten dollars under Sec. 25-2, but each day the obstruction, whether it's a vehicle, box, or table, remains in place counts as a separate offense.
