Mount Vernon, NY Sidewalk & Pedestrian Rules: Obstruction Rules (2026)

Section 227-38 bars obstructing, encumbering or occupying any public street, highway or sidewalk without a written permit, with only a narrow carve-out for authorized floral displays under a City urban beautification program. Construction machinery or equipment that blocks the right-of-way needs the same permit (§ 227-39). Permits are valid for up to 30 consecutive calendar days, extendable in writing before expiration (§ 227-40), and the application must list the property owner, exact location, and nature and dates of the obstruction (§ 227-41). Before a permit issues, the applicant must file public liability insurance of at least $200,000 per person and $300,000 per accident, plus $25,000/$50,000 property damage coverage approved by the Corporation Counsel (§ 227-42).

The fee is $5 per week per linear foot of material or machinery placed parallel to the curb, or $75, whichever is greater, waived for government, school or nonprofit hospital work (§ 227-43). The permitted obstruction can never exceed one-third of the street's width, and manholes, catch basins, hydrants and fire alarm boxes must stay clear (§ 227-46). Permit holders must keep a four-foot clear pedestrian passageway, erect barricades, and provide a sidewalk shed meeting the Building Code if materials pass overhead by crane or hoist (§ 227-47). Loading and unloading directly from curbside vehicles is exempt from the permit requirement (§ 227-48).
