Under Newark Municipal Code Chapter 29:4 (Encumbrances Upon and Injury to Streets and Sidewalks), it is unlawful to place or permit any box, barrel, can, package, or other thing on or over any sidewalk or public place that obstructs pedestrian passage. Each day of violation constitutes a separate offense. Limited exemptions exist for retail vendors of fruits, vegetables, flowers, and plants who may display merchandise on sidewalks provided the display extends no more than 2 feet from the building facade and does not impede pedestrian traffic, in accordance with applicable city vendor ordinances. Construction-related sidewalk closures require a permit and installation of protective structures under Chapter 29:5. Placing dumpsters, scaffolding, or construction materials on sidewalks without a permit is prohibited. Snow and ice removal is also required -- property owners must clear sidewalks within a reasonable time after snowfall under Newark municipal code. Damaging or injuring any sidewalk, curb, or street surface is a separate violation under Ch. 29:4.
