(A) It shall be unlawful for any person: (1) To erect, build, construct, deposit, or place on or in any street or sidewalk, right-of-way, or any place where the public has the right of passage, any building, structure, or obstruction of any kind whatsoever, including the temporary or permanent placement of any packages, goods or personal items including, but not limited to, bicycles and motorized scooters, except as momentarily placed at a person’s feet. Any such obstructions are declared to constitute a hazard and may be removed by the city and disposed of accordingly; or (2) To enclose any street, park, or other public property.

" Subsection (A)(2) separately bars enclosing any street, park, or other public property. 29, allows curbside mail receptacles up to five feet tall mounted on posts no larger than 4-by-4-inch wood or 2-inch steel/aluminum pipe buried no more than 24 inches deep, so long as the receptacle does not block vehicular or pedestrian traffic. 30, goes further: any building, structure, or obstruction abutting or encroaching on a public street, alley, sidewalk, or right-of-way swale area is declared a public nuisance, and the owner, lessee, agent, or any person responsible must remove it or otherwise satisfy the section's exemption requirements.
Failure to remove the nuisance, or the initial placement of it, is each separately punishable. The ordinance dates to Ord. 91-22 (passed 12-11-90) for the sidewalk-construction chapter context, with the obstruction language rooted in the 1958 Code and carried forward through later codifications.
Violations & Fines
Placing or failing to remove a prohibited obstruction is a punishable offense under § 100.35(C). Where no more specific penalty applies, the City's general penalty in § 10.99 sets a fine up to $500, imprisonment up to 60 days, or both, capped at whatever penalty state law imposes for similar conduct, and each day the obstruction remains is a separate offense. Code Enforcement or Public Works can remove and dispose of the obstruction directly.
