Summary
Independence puts sidewalk, curb, and gutter repair on the abutting property owner or occupant, who must keep them in repair and at the established grade or face City action.
No owner or occupant of any house, building, or premises shall permit or allow the sidewalk, or any curbing or guttering in front or along side of such house, building, lot, or premises to be removed or remain out of repair, or shall suffer or allow such sidewalk, curbing, or guttering to be or remain above or below the established grade of the same, except as approved by the Director of Municipal Services. Prior to the approval of a Survey Development, the Community Development Department will inspect the existing facilities and require proper maintenance to occur prior to issuance of any building permit.
It shall be the duty of all persons owning or occupying any property fronting upon any street to keep the right-of-way area, including sidewalk, parkway between the sidewalk and street, curbing, or guttering in front and alongside such property and on the same side of the street in good order and to clean the same and remove from any such sidewalk, parkway between the sidewalk and street, curbing, and guttering all ice, snow, earth, or other substances that obstruct or render the same dangerous.
